U.S. Department of Labor (DOL) fiduciary regulation specifically concerns about the DOL's Employee Benefits Security Administration (EBSA) proposed and then finalized rule, "Retirement Security Rule: Definition of an Investment Advice Fiduciary" and related prohibited transaction amendments. The rule would institute a fiduciary standard and dramatically change who is allowed to sell products. This could be detrimental to the people it is meant to help the most (underserved and BIPOC communities), and that the Securities and Exchange Commission's (SEC's) Regulation Best Interest (Reg BI) rule, the National Association of Insurance Commissioners' (NAIC's_ model Best Interest regulation, and the DOL's proposed impartial conduct standard provide guidance for those advisers already held to their client's best interest standards. Discussions included advocacy for the dismissal of the rule and consideration of a potential Congressional Review Act after finalization.
